Excerpt from Judicial Tenure Act: Hearings Before the Subcommittee on Improvements in Judicial Machinery of the Committee on the Judiciary, United States Senate, Ninety-Fourth Congress, Second SessionThe thrust of this legislation is to provide a new system or strue ture, separate and distinct from impeachment, for the removal or censure of Federal justices and judges. The bill also authorizes the involuntary retirement of Federal judges or justices for mental or physical disability, including habitual intemperance. In this latter respect, relating to involuntary retirement, the bill is similar to section 372(b) of title 28, except that it would include Justices of the Supreme Court among those judges who can be involuntarily retired.Consideration of S. 1110 raises a number of legal and policy ques tions which are not of easy resolution.
