Excerpt from A Dissertation on Infanticide: In Its Relations to Physiology and JurisprudenceIn aphysiological point of View, we should find it convenient to make. A distina. Tion between the destruction Of the life of a child before, and that committed after, its vital connexion with the mother' had ceased, and the acts alluded to might be termed, respectively, feticide and infantictde but such a distinction is not acknow ledged by the English laws. By our code Of jurisprudence, the destruction lof the life of a man, using the term in its generic sense, is regarded distinctly as it i§_efi'ected before, and as it is effected after, the commencement - Of his birth. The former is viewed only as it is a mean for procuring the abortion ofr the subject, and it is this consequence which is assumed as the ground for the~attachment of penalty: the latter is properly homicide, whatever may have been the duration of life, either before or after the period of birth though it is convenient, in regard to medical jurispru dence, to contemplate the destruction of life at a certain epoch in a distinct manner.About the PublisherForgotten Books publishes hundreds of thousands of rare and classic books.
