Excerpt from A Letter to the Commissioner of Indian Affairs: Upon the Claims of the Indians, Remaining in the States East Sir: Whereas the Cherokees residing west of the Mississippi river have sent on a Delegation to this place, for the purpose of concluding a treaty to recede to the United States 800, 000 acres of land acquired by the Eastern Cherokees, under the treaty of 1835, and whereas said Delegation have, for some time past, been endeavoring to conclude a treaty upon terms which, if complied with, will exclude from its benefits the portion of the tribe remaining in the States east, who have an equal interest with the portion of the tribe west, in the lands proposed to be ceded. In explanation of their rights, I beg leave to file this additional exposition, not only of their rights to the lands west, but also of their claims to be provided for, if the treaty be concluded. At the time the treaty of 1835 was concluded, the lands ceded under the first article were owned by the eastern portion of the tribe, as designated by a census taken immediately preceding the date of the treaty, now on file in your office, which is referred to in the fifteenth article. They held their lands as a family, not as a civilized nation, hence the necessity of a census, to know with whom to treat and to whom to make payment. A comparison of the census taken of the North Carolina Cherokees, under the act of July 29, 1848, with the census taken of the tribe in 1835, will prove that those included in the latter were embraced in the former census. It is not necessary, in this explanation, to inquire into the competency of the individual Cherokees of Georgia to make the treaty, without the knowledge or consent of the portion of the tribe residing in North Carolina.
