Comparative law is highly present in the judgments of the ECtHR. This thesis examines the role of international Soft Law in that regard. Through a comprehensive empirical study, it determines the role of legally unbinding CoE-Documents in the Court's jurisprudence and focuses on their importance in establishing a European consensus. Subsequently, it locates the legal figure of European consensus in the methodology of comparative law and makes proposals for a more structured consensus determination.
