»Applicability of Juvenile Criminal Law to Adolescents«
As adolescents, 18- to 20-year-olds are treated exceptionally in German criminal law, as they can be sentenced under both juvenile and general criminal law. Yet, the adequate regime for treating adolescent criminal acts has been a long-standing subject of scholarly and legal policy debates alike. Erik Weiss takes a look at the conditions for the application of § 105 (1) JGG, offering a methodologically sound interpretation. He shows that from both dogmatic as well as factual viewpoints, full integration into juvenile criminal law is solely convincing, a goal to be achieved by reform of the third part of the JGG.
