The question as to whether an employer may terminate the employment contract arises when an employee is suspected of having committed a serious breach of duty or a criminal offence. While the German Federal Labour Court (BAG) allows for such termination when there are strong suspicions, some legal experts remain sceptical. Katarzyna Zborowska generally concurs with the BAG to the extent that a termination is generally allowed under these circumstances. However, she develops an independent approach limiting termination on grounds of suspicion to a necessary minimum.
