Excerpt from Proceedings and Debates in the House of Representatives of the Commonwealth of Massachusetts: During the Four Days Previous to the Election of a Speaker, in January, 1842, Compiled From the Several Reports of the Same, Revised, Corrected, and Preceded by an Introduction Another purpose, which I have in view in this publication, is to call the attention of the people and of the legislature to a practical defect in our fundamental laws, as regards the consti tution of the house of representatives - a defect which does not exist in the constitution of the house of commons, the great original of all modern legislative assemblies, and from which our own system was free, til within a few years. According to our present fundamenta laws, as practically administered, there is absolutely nothing to prevent an unauthorized person from coming in and taking a part in the preliminary proceed ings, and, in short, assuming and exercising the functions of a member, until discovered and prohibited by the house. This is a defect, which ought to be remedied, in time to prevent, if possible, another occurrence like that which gave rise to the debates and proceedings recorded in the following pages.
