In these facts, and in the singular absence of treatises on the subject, the following pages might alone find their justification, for although the primary end the author has had in view has been to compress into a single volume a clear and concise statement of the legal rules and principles which determine the effect of the instruments and modes whereby private loans and debts are secured, he has, in the pursuit of that end, and as ancillary thereto, discussed most points of any legal moment connected with loans and debts of a public or marketable character.
