Excerpt from The Record: Spring 1973It is not, in our view, the function of the law to intervene in the private lives of citizens, or to seek to enforce any particular pattern of behaviour, further than is necessary to carry out the purposes we have outlined.There are some who question the validity of the principle formulated and who consider that for the law to permit unrestricted indulgence in private vice and to fail to enforce generally accepted standards of morality may well eventually weaken and harm the fabric of Society as a whole.In practice the intervention of our criminal law in the realm of morals is, Ithink, in general confined to cases where this is necessary for the preservation of public order and decency or for the protection of individuals or classes of individuals. Thus, for example, prostitution is not in itself a criminal offence, but public soliciting for immoral purposes or males living on the earnings of prostitution is prohibited. Fornication is not in itself an offence but sexual relations with girls under the age of 16 and indecent assaults are criminal and as I have indicated while homosexual acts when done in private between consenting adults are no longer an offence, if not done in private or if either of the participants is under 21 they remain criminal.About the PublisherForgotten Books publishes hundreds of thousands of rare and classic books.
