But still there are some defects in it which require a remedy. The power of leasing for building purposes should be extended to 999 years. The restrictions placed by sect. 15 on the sale or lease of the principal mansion house, should be removed, or at least the meaning of the term mansion house should be defined, and a statement of the tenant for life that any house or land he was selling did not comprise the mansion house or its demesnes, &c., , should be conclusive evidence in favour of a purchaser. (a) The Act contains no definition of capital money the Bill did contain a not very satisfactory one. If the Legislature finds it impossible to frame a good definition, one will doubt less be evolved (at a considerable expense to the public) by judicial decision. At present sometimes it will be well for settlors to declare that certain specified profits shall not be capital money, but shall belong to the tenant for life, and thus supplement the Act.
