Excerpt from The Traffic Library Interstate Commerce Law, Vol. 2: Act to Regulate Commerce Administrative Interpretation Part II of "Interstate Commerce Law" continues the amplification by sections of the judicial construction and administrative enforcement of the Act to Regulate Commerce. The important subject of discrimination is begun in this volume, but because of its great scope, is concluded in the next succeeding volume or Part III. Sections 2, 3 and 4, - and section 1, to the extent that it prohibits unreasonable rates and the conditions of unreasonableness, - present the major purpose of the Act to Regulate Commerce, which is to destroy unjust discrimination. In the very nature of things, the original Act to Regulate Commerce passed in 1887 (and then known as the Cullom-Reagan Bill) was largely tentative and experimental. Its fundamental principles, however, were not alone the result of experience but also of exhaustive investigation. The essential purpose of the Act then and now was to free interstate transportation from undue and unjust discriminations. Through successive enlargements of its powers and the experience gathered by its administrative machinery, the provisions of the Act directed against this evil of public transportation have been developed into a system of control of the public service of railways and the relationships that exist between them and their patrons which has accomplished the practical extirpation of unjust discrimination.
